A public hearing will be held in the West River Conference Room, 124 South Euclid Avenue, 2nd Floor, Pierre, South Dakota, on October 15, 2014 at 10 a.m., to consider the adoption and amendment of proposed rules to the following: See the Rules Text (in Adobe .pdf format*) as originally posted on September 24, 2014, or the Revised Rules Text (in Adobe .pdf format*) as of November 5, 2014.
The effect of this rule change is to update the Risk Based Capital reporting requirements for insurers and health organizations.
The reason for adopting this rule is to be consistent with the National Association of Insurance Commissioners' Model Acts.
The effect of this rule change is to update Annuity Mortality tables.
The reason for adopting this rule is to be consistent with the National Association of Insurance Commissioners' Model Act.
Chapter 20:06:40, 20:06:58
The effect of this rule change is to provide updates to the mental health parity rules in order to be consistent with the final rules under the Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008. In order to provide these updates the mental health parity rules currently in chapter 20:06:40 are being repealed and transferred into chapter 20:06:58.
The reason for adopting this rule is to be consistent with the federal mental health parity regulations.

The effect of the rules is to update standards for qualified health plans, minimum essential health benefits, and the sale of individual health insurance outside of an exchange.
The reason for adopting this rule is to meet minimum federal requirements.
After the hearing, the Division of Insurance will consider all written and oral comments it receives on the proposed rules. The Division may modify or amend a proposed rule at that time to include or exclude matters that are described in this notice.
Notice is further given to individuals with disabilities that this hearing is being held in a physically accessible place.
